Overview

These Terms of Service govern your access to and use of TouchHue, including our website, applications, AI-powered image workflow, account features, billing, credits, and related services.

By accessing or using TouchHue, you agree to these Terms. If you use TouchHue on behalf of a company or organization, you represent that you have authority to bind that entity, and "you" includes that entity.

Eligibility and Accounts

You must be legally capable of entering into a binding agreement to use TouchHue. You are responsible for:

  • providing accurate account information
  • keeping your login credentials secure
  • all activity that occurs under your account
  • promptly notifying us of unauthorized access or security issues

We may suspend or terminate accounts that violate these Terms or create risk for TouchHue, other users, or third parties.

The Service

TouchHue provides tools for product image upload, scene workflows, AI-assisted generation, retouching, styling, output expansion, asset storage, credits, subscriptions, and related features.

We may change, improve, suspend, or discontinue any part of the service at any time, including beta or experimental features.

Your Content

Ownership

You retain your rights in the images, prompts, text, and other content you upload to TouchHue ("User Content"), subject to any rights of third parties.

License to Operate the Service

You grant TouchHue a non-exclusive, worldwide license to host, store, reproduce, modify, transmit, and process User Content solely as needed to:

  • provide the service you request
  • generate and deliver outputs
  • maintain security and reliability
  • troubleshoot issues
  • comply with law and enforce these Terms

Responsibility for User Content

You are responsible for User Content you submit and for ensuring that you have all rights, permissions, and legal bases needed to use it with TouchHue.

You must not upload or submit content that:

  • infringes intellectual property, privacy, publicity, or other rights
  • violates law or regulation
  • contains malware or harmful code
  • is fraudulent, deceptive, defamatory, or abusive
  • is NSFW, sexually explicit, pornographic, nudity-focused, fetish, or otherwise adult-oriented
  • contains unlawful, exploitative, or prohibited content
  • is intended to generate, edit, enhance, or distribute NSFW or sexually explicit outputs through TouchHue

AI Features and Outputs

TouchHue uses automated systems and third-party providers to generate and edit visual outputs.

You understand and agree that:

  • outputs may be non-unique and may resemble content provided to or generated for other users
  • outputs may be inaccurate, incomplete, or unsuitable for your intended use
  • TouchHue does not guarantee that outputs are free of third-party rights claims
  • you are responsible for reviewing outputs before commercial, advertising, marketplace, or legal use

As between you and TouchHue, you may use outputs generated for your account for lawful business or commercial purposes, subject to these Terms, applicable law, third-party rights, and any third-party provider restrictions that may apply.

TouchHue Intellectual Property

TouchHue and its licensors own the service, including software, workflows, interface design, branding, and underlying technology. These Terms do not transfer ownership of TouchHue intellectual property to you.

If you provide feedback or suggestions, we may use them without restriction or compensation.

Acceptable Use

You agree not to:

  • use TouchHue for unlawful, infringing, fraudulent, or deceptive activity
  • upload content you do not have rights to use
  • reverse engineer, decompile, scrape, or probe the service
  • interfere with security, rate limits, credits logic, or service integrity
  • bypass usage limits, pricing, or access controls
  • use the service to create or distribute harmful, abusive, or unlawful content
  • use the service to generate, edit, enhance, upload, or distribute NSFW, sexually explicit, pornographic, nudity-focused, fetish, or otherwise adult-oriented content
  • resell or provide unauthorized third-party access to TouchHue

Plans, Credits, Billing, and Renewals

TouchHue may offer subscriptions, top-ups, trial credits, and other paid features.

Credits

  • credits may be required for certain actions
  • credits are not money, are not banked funds, and are not transferable
  • credits may expire as described in the applicable plan, checkout flow, pricing page, or account page
  • TouchHue may change credit costs prospectively

Subscriptions

  • subscriptions may automatically renew unless canceled before the next billing cycle
  • you authorize TouchHue and its payment providers to charge the applicable recurring fees and taxes
  • you may manage or cancel renewals through the billing tools provided in your account, when available

Top-Ups and One-Time Purchases

  • top-ups and one-time purchases are generally non-refundable once credits or service value has been delivered, except where required by law
  • if you believe a technical issue prevented delivery of a purchase, contact support@touchhue.com

Pricing Changes

We may change pricing, plan structure, features, or included credits from time to time. Changes will apply prospectively unless otherwise stated.

Third-Party Services

TouchHue may depend on third-party providers for authentication, payments, AI inference, cloud storage, analytics, email, and infrastructure. We are not responsible for independent third-party services, websites, or policies.

Suspension and Termination

We may suspend, limit, or terminate access to TouchHue if:

  • you violate these Terms
  • your use creates legal, operational, or security risk
  • required by law or third-party provider restrictions
  • the service or a feature is discontinued

You may stop using TouchHue at any time. Termination does not affect accrued payment obligations or provisions that should survive by their nature.

Disclaimers

TouchHue is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, TouchHue disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted operation.

Limitation of Liability

To the maximum extent permitted by law, TouchHue and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity, arising out of or related to your use of the service.

To the maximum extent permitted by law, TouchHue's aggregate liability for claims arising out of or related to the service will not exceed the greater of:

  • the amount you paid TouchHue in the 1 month before the event giving rise to the claim, or
  • USD $100

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You agree to defend, indemnify, and hold harmless TouchHue and its affiliates, officers, employees, contractors, and licensors from claims, liabilities, damages, judgments, losses, and expenses arising out of or related to:

  • your User Content
  • your use of TouchHue
  • your violation of these Terms
  • your violation of applicable law or third-party rights

Governing Law and Disputes

To the extent permitted by applicable law, these Terms are governed by the laws of the jurisdiction in which the TouchHue contracting entity is established, excluding conflict-of-law rules. Mandatory consumer protections that apply in your place of residence remain unaffected.

You and TouchHue agree to try to resolve disputes informally first by contacting support@touchhue.com.

Changes to These Terms

We may update these Terms from time to time. If you continue using TouchHue after updated Terms become effective, you agree to the revised Terms.
